Post the judgement on the Samjhauta train blast case, where the special judge acquitted all accused, Pakistan jumped in questioning the decision. Its foreign minister, Shah Mehmood Qureshi, stated, ‘The decision by India’s National Investigation Court has shaken the people. The four accused were acquitted after 11 years, including Swami Aseemanand, who had already confessed his crime.’ He added, ‘Pakistan strongly protested on this development and gave a demarche to India.’ He also added that Pak was studying the case and contemplating options.
Qureshi even attempted to raise this issue in the meeting of the Organization of Islamic Countries when he attended a special session of foreign ministers called to discuss the causes, impacts and way forward post the New Zealand attack on Mosques, which left 50 dead. In this meeting he stated, ‘Recently, an Indian court exonerated Hindu terrorists who had confessed to killing 68 people, mostly Muslims ─ including 44 Pakistanis ─ on a train in India.’ He hoped to gain sympathy, but no nation reacted to his statement as everyone discussed increased Islamophobia in the West.
Surprising, this is the same Pakistan which has refused to move ahead on the Mumbai and Pathankot attacks, despite all proof including from their own surviving terrorist, Ajmal Kasab. It has been over a decade since the Mumbai attack and yet the case has not progressed at all. Imran had stated post becoming the Prime Minister that processing the Mumbai attack case would be a priority. Till date not a single hearing has been held. He like other Pak politicians only speak but lack the power to act, since further action is blocked by the deep state.
In the Pathankot case, there was a joint investigation by both Pak and India at the air base, post which there has been no forward movement at all. Pak as usual claims that there is no proof. Even in the case of the Pulwama attacks, Pakistan continues to refuse that Jaish-e-Mohammad (JeM) had accepted responsibility.
Qureshi stated that Pakistan is studying the Pulwama dossier given by India. This contrasts with his earlier comment when he stated that the Pulwama dossier has no new evidence. As before, the dossier would die a natural death and no action would be taken. He had earlier mentioned that Pak can only arrest Masood Azar if India provides evidence which can be upheld by Pak courts. Since the courts operate under the deep state, how would they ever accept Indian evidence.
This is the same foreign minister who had admitted in a press interview with foreign journalists that his government is in touch with Masood Azar, the head of JeM and that he is being treated in military hospitals. He admitted the presence of the organization within Pak, which was debunked by the head of the Pak Inter Services Public Relations (DG ISPR), who stated that the JeM is banned in Pakistan.
All reasons for Pak terrorist group leaders being taken into protective custody, under international pressure, was smashed when the head of the Pakistan People’s Party, Bilawal Bhutto, stated, that they have been taken into custody to save them from being ‘bombed by India’. Bhutto had also demanded the dismissal of three ministers in the present government who had links with proscribed organizations and had sought their support in willing elections. Since Bhutto made these statements, the deep state launched actions to harass him. He is being questioned by the National Accountability Bureau in multiple cases.
In the case of India, the judiciary is independent and has no pressure of the state or the government on it. It is the reverse in Pakistan. Just for questioning the power of the deep state, Nawaz Sharif, a sitting Prime Minister, was removed from his chair and is in jail. The intention was to deny him a chance from winning the elections as the deep state had already decided his replacement.
The best action for India is to ignore comments flowing from Pak. India still investigates and acts, while Pak refuses to even investigate. India has closed the Samjhauta case, while Pak still needs to complete the hearings into Mumbai, commence Pathankot and even consider investigating Pulwama. This is the difference between a genuine democracy and one run by the military which protects terrorist leaders.
